HB 168 prohibits selling or providing an over-the-counter sexual assault evidence kit and imposes a penalty for a violation.
Utah Representative Angela Romero has requested that nurses statewide write their senators to let them know how very important this ban is for the accurate and legal collection of evidence post-sexual assault.
Some companies are currently selling sexual assault evidence kits that women can use at home. There are serious problems with this. None of the evidence collected by a woman in her home is acceptable evidence for a court proceeding. And, following a sexual assault, a female victim should be seen by a professional Sexual Assault Nurse Examiner (SANE nurse) to provide initial assessment, evidence collection, referral to resources, and initial counseling.
